Please read these Terms of Service (“Terms”) carefully before using our services or purchasing our products. By engaging with our digital services or purchasing physical goods, you agree to be bound by these Terms.
1. Scope of Services
We provide a range of digital design, web development, and physical creative goods (fashion and art). Each project is governed by these general terms, supplemented by any specific Project Proposal or Statement of Work (SOW) agreed upon in writing.
2. Delivery & Logistics
2.1 Digital Assets
All digital deliverables are transmitted via secure cloud-based links or encrypted email. The Client is responsible for downloading and verifying these files within 30 days of delivery.
2.2 Physical Shipping
- Local (Dubai): Delivered via local courier. Risk of loss passes to the Client upon delivery to the specified address.
- International: Shipped via DHL/FedEx. The Client is the “Importer of Record” and is responsible for all applicable customs duties, taxes, and regulatory fees.
3. Payment & Finality
3.1 Approval of Design Services
Once the Client provides written or electronic approval of a “Final Draft,” the service is deemed complete. Due to the labor-intensive nature of creative work, approved designs are non-refundable.
3.2 Physical Product Exchanges
Exchanges for apparel are permitted within 7 days of receipt. Items must be unworn, unwashed, and in original packaging. We reserve the right to refuse an exchange if the item shows signs of wear or damage.
4. Warranties & Post-Launch Support
4.1 Technical Warranty
Web services include a technical maintenance period of 6 to 12 months (as specified in your contract). This warranty covers:
- Correction of bugs or coding errors.
- Critical security patches.
- Compatibility maintenance for major browser updates.
4.2 Intellectual Property & Archiving
We warrant that all Creative Works are original. Upon final payment, full copyright is transferred to the Client. We will maintain an archive of high-resolution source files for a minimum of 24 months as a courtesy backup for the Client.
5. Privacy & Confidentiality
5.1 Data Protection
We employ industry-standard encryption and strict internal protocols to protect Client data. We do not sell or lease Client information to third parties.
5.2 Portfolio Rights
Notwithstanding the transfer of copyright, we reserve the right to showcase the completed project in our professional portfolio. However, this will only occur after obtaining the Client’s explicit written consent.
6. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the total amount paid by the Client for the specific service or product in dispute. We are not liable for indirect, incidental, or consequential damages.
7. Governing Law
These Terms are governed by and construed in accordance with the laws and regulations of the United Arab Emirates, as applied in the Emirate of Dubai.
Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the company service to see if you are using it. The service privacy policy is available here. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
